For several years I had my site hosted in a company in the US - some guy who runs a several servers from RackShak now EV1.
Anyways.. I purchased a reseller account from him a year and a half ago and last December it expired. Since I still had few users who paid for additional time, I asked him to give me a month by month service.

Well... I no longer needed his service past April 22nd ,2004,.. so I paid him yesterday my fee and cancelled the continuation of my PayPal subscribtion of monthly fees.

The f(&*ker terminated my accounts. Even though I paid him Yesterday for the next 30 days.
I asked what the f*(k?!
He says,..and here is his email:

"you are unbelievable.

First you bargain me down to practically nothing for the sites you
have --- 40 lousy dollars a month for 10 full domain sites --- and then
you even cancel THAT payment.

I'm in the process of turning off all your sites.

Steve"

I just paid the guy $40 and indeed cancelled FUTURE payments,.. but the guy continued:

"you will need to sign up again for the 40 plan.
Just use the same link you used when you originally signed up.

There is a 40 penalty to restore service to all the domains"

So my response:

"Excuse me.
Penalty?
Ok.. you need to refund my $40 paid for until April 22nd. The membership
stipulates very clearly. $40 for 30 days.
So skipp the penalty you are attempting to impose on me and just bring back
those accounts.
I don't mean to be a bad guy, but you have dealt with this in the most
terrible way concieved.
I paid for your service in my ns20.super-hosts.com in good faith. That
should be instated immediatly regardless of my subscription.[my regular
account not my reseller account -MS2]
Second,. I'm paid for until April 22nd. So,. if you have issues with that,.
you can tell me. I'll forward this to Paypal
and we can resolve it through their claims department."

Well... his response:

"Nope, we're not going to do it that way. First of all, our AUP stipilates there are NO refunds on monthly payments --- none. Second, the AUP also specifically states that in the event client cancels a monthly payment plan, the hosting STOPs --- doesn't matter when during the month, the hosting stops.

Your problem here is you have beaten me down to such a ridiculous number for your hosting, you are now almost not worth the trouble.

Frankly, for 40 a month, you are getting an obscenely good deal.

And then, to top it all off, you CANCEL the friggin monthy payment, the paltry tiny sum I'm getting for hosting your TEN sites....sheesh....

I must also tell you, I do not accept your explanation either, you didn't hit the wrong button, you knew exactly what you were doing. Evidently 4 dollars a month per site is not quite cheap enough for you, you were trying get FREE hosting, hoping we wouldn't get the email of cancellation or perhaps would overlook it.

No, this is non negotiable, I want another 40 payment, or the sites stay down.

So.. now the guy is trying to blackmail me to pay another $40!

Well... I just had enough with this guy. I sent a dispute to PayPal.

And the emails kept coming:

"I can tell you right now, if you press the 40.00 dispute with PayPal, you will
never retrieve a single byte of the files currently on our servers, they will all
be deleted. If that's the way you want to go, please proceed.....in fact, frankly
I'm tempted to just refund the 40 and delete all your sites --- will that make you happy, your 40 dollars back? Steve Gunnels"

You think that stoped??
It just kept coming:

"I will give you the next 6 hours to decide.

Either you withdraw the PayPal dispute in the next 6
hours -- or I will refund the 40.00 via PayPal and then I
will delete ALL your sites.

Your choice.

So now there is an ULTIMATUM!!!!

luckily to me,. of the 10 sites that I was hosting.. I had tranferred all of them
but 3. Of the 3,.. two of them are only email accounts,.. so we are down to
only One account. I'm sorry for this for the single guy who is actually downunder somewhere out there.. the best that I can do is give him a bonus on the new server.

I'm waiting for the 6 hours to end. I'd like to get my money back.

You have no backup of these sites????????????

Backups are done manually by the users. They can do it through their control panel.
That was how it was in the old server.
I lost one site that I hope they guy who owns it will not resent me till the end of time,..
All the others were transferred over safely and clean.

A day after,...

I sent an email:

"Steve,

I failed to follow your logic. I read your emails again to try to understand
them, but perhaps I misunderstood you.

1. You claimed that I was trying to get free web hosting.
Why then did I pay you the $40? I could have just cancelled that before
the charge occured. I wanted to the opposite. To continue
the service for another month.

2. You threaten me "if you press the 40.00 dispute with PayPal, you will
never retrieve a single byte of the files currently on our servers".
You use abusive language "40 lousy dollars"
You attempt to penalize me " I want another 40 payment" as if I'm at
fault for continuing the service with you.

3. You terminated my regular account that was paid for, not my reseller
account. Why?

What did I do to you that makes you act so vengenceful?
Were you not happy to get my money for the past year?
Did I skipp a payment?
Did I not buy more from you?

You act as if I insulted you by not buying more. Well.. that is why I didn't
buy the
annual plan. My business has gone down, and I can't keep my hosting service
up.

But you act as if this is a personal offense against your service.
Why?
After 6 years of being with your service you act as if I'm trying to hurt
you or attack you. I'm not.

Just because I can't afford anymore future hosting all of a sudden you turn
against me with this hostile maner?

Did you get any abusive response from me with all that?
If my money is not good enough for you, and I'm a pain as a customer,. you
should
just let me know that it is not working out for you and we need to depart.
But you took a different approach. One that I cannot understand.
You threan me,. you abuse me, you abuse my customers.

This is very weird for me to recieve such behaviour.
I spent 7 years as a consultant for Fortue 100 companies, and in my entire
career I have yet to encounter such abusive behaviour from a provider that
is being paid, and that is regardless of the payment amount.

I was about to sign for an additional time with my personal account, but
obviously
that would not be possible with the attitude and responses you display.

Perhaps you want to do some thinking about this and reflect upon it.

I wish you all the best. Really,. I hope your business will succeed."

His response:

"Alon perhaps I overreacted. If so, I apologize.

You have to understand it from our point of view -- when you cancel a subscription
it creates a huge amount of unnecessary work for us. That, combined with the tiny
price you are paying for your 10 sites, makes for a very frustrating situation.

Suppose we try this. If you will withdraw your dispute over the 40 dollars, I will create
a link for you to resume the payments -- no additional payment now, mind you, just
sign up and it will bill the 40 in another 30 days. Once you sign up again, all the sites
will come back up - fair enough?

Well.. I have the Aussie guy (that now is very pissed about his stuff gone),.. and I decided that I'm looking for the business, not the personal plan of "being right".

I agreed and the service was restored. .and immediatly I pulled everything there is from the server and transferred it all to the new server.

I don't mind that I paid the $40 after all. Simply because I meant to pay them and I actually did pay them at begining of all this. So I'm happy I got my customer's data safe and at no additional cost.

phewwwwwww.... now I can catch my breath.
